The term LMA shall mean and include the Legal Metrology Act, 2009 (https://consumeraffairs.nic.in/acts-and-rules/legal-metrology/the-legal-metrology-act-2009) as amended read with any rules or regulations that might be framed thereunder.

A User agrees not to submit any property descriptions, photographs, financial, contact or other information at the time of inclusion in the Property Data to the Gruham Gallery.
Unless the User submitting such listing/advertisement has obtained all necessary rights and authorization from the owner of such property. Or the holder of power-of-attorney, including the photographer or copyright owner of any photographs.
To publish and advertise such properties on a User's website or on the Gruham Gallery. Similarly, the Gruham Gallery does not assume any ownership interest in any person, directly or indirectly, with respect to banners hosted on its website by its clients, which are strictly in the nature of a sale of space by the Gruham Gallery and have not been made. No independent verification has been conducted as to the authenticity or compliance requirements of such photos/banners/listings, as may be required under any applicable law.
If the User is covered under RERDA, he shall ensure compliance with all necessary compliances, including but not limited to obtaining the necessary registrations etc. The User shall disclose all material information required by and in respect of their registrations under RERDA and all properties submitted including the current condition and nature of such property and whether or not the property is free from all encumbrances. The User shall, in addition, furnish a brief background of such property in terms of title, ownership and possession, and the Gruham Gallery may also require the User to support his/her claims in respect of the condition of the property with such documents as may be specified by it from time to time. The User may be required to support his/her claims as to the nature and condition of the property by making an affidavit attesting to the authenticity of the information/data so provided/displayed.
The Gruham Gallery may, in its sole discretion, but without any liability, search for and remove properties alleged to have been submitted in breach of this provision. In addition, Gruham Gallery may require additional evidence of compliance with this provision from users alleged to have submitted properties or other information/data in violation of these Terms and Conditions. Gruham Gallery, in its sole discretion, will terminate the account of any user who repeatedly or willfully violates these Terms and Conditions and refuse service to them.
Furthermore, User agrees to allow the Property Listing, or any portion thereof, to be searched, displayed, accessed, downloaded, copied and otherwise referenced by users of User's website or the Gruham Gallery website. Gruham Gallery shall have the sole right to select the manner in which any Property shall be searched, displayed, accessed, downloaded, copied and otherwise used, and Gruham Gallery reserves the right to modify the Property Listing in the exercise of its rights under these Terms and Conditions. In addition to the foregoing, User agrees. Represent and warrant that all properties and related information provided by the User will be accurate. The User will not permit the posting of a property on the Gruham Gallery under any name other than the name of a real estate agent duly authorized and engaged by the owner of the property in this regard.
Gruham Gallery will post information regarding properties on designated sections of Gruham Gallery or on parallel sites. Gruham Gallery operates in a manner consistent with fair business practices.
Gruham Gallery assumes no responsibility for verifying/verifying the accuracy of reports or data files submitted by users to Gruham Gallery. While Gruham Gallery will make all reasonable efforts for data backup and business recovery, users shall be solely responsible for maintaining backup copies of all information, photographs and other materials submitted/submitted to Gruham Gallery. Users, who are purchasing/renting properties through Gruham Gallery, must verify the details of the property/asset as well as its rights, title, ownership, liens, etc. on their own. If in any circumstances the property information or the user information is inconsistent, Gruham Gallery reserves the right to remove all or any portion of the user's postings on Gruham Gallery without notice.

The User shall make 100% advance payment for the services offered by Gruham Gallery. Payment for the service once subscribed by the Subscriber is non-refundable and no amount paid will be refunded. However, in case of any situation arising, the entire process for refund shall be at the sole discretion of Gruham Gallery. Which shall be accepted by the User. It does not give any guarantee for the accuracy or timeliness of the refund reaching the User's card/bank accounts.
The User acknowledges and agrees that Gruham Gallery shall be entitled to set off any amount paid or payable by the Subscriber/User against any amount.
Payable by the User to Gruham Gallery under any other agreement or any commercial relationship for other products/services. Gruham Gallery does not guarantee server uptime or the proper functioning of the applications. All is on a best-effort basis and liability is limited to a refund of the amount paid.
Gruham Gallery assumes no liability for free services. Gruham Gallery reserves the right to amend/modify or change all or any of the disclaimers or terms of the agreement at any time without prior notice. All terms/disclaimers, whether specifically mentioned or not, shall be deemed to be included if any reference is made to them.
Gruham Gallery uses the utmost care possible to ensure that all or any data/information in connection with electronic transfers of money does not fall into the wrong hands. To complete online transactions involving payments, the user is directed to a payment gateway, Gruham Gallery does not store or retain credit card or other data.
Transactions occur over a third-party network that is not controlled by The Gruham Gallery. Once a credit card transaction is completed, payment information is not accessible to anyone at The Gruham Gallery after the online transaction is completed on the payment gateway, ensuring maximum.
Gruham Gallery shall not be liable for any loss or damage caused by the inadvertent or otherwise disclosure of any information relating to or related to online transactions using the user's account or credit cards/debit cards or their verification process and for any errors, omissions or inaccuracies in the details or concerning any information so disclosed and used in pursuance of legal process or otherwise.

Although the Gruham Gallery Payment Reconciliation Team operates from 9.30 am to 6.00 pm on a business day basis, Monday to Saturday, Gruham Gallery makes no guarantee as to the accuracy or timeliness of refunds reaching subscribers' card/bank accounts. This is due to the multiplicity of entities involved in processing online transactions, issues with the currently available internet infrastructure, and the working days/holidays of financial institutions. Refunds will be at the discretion of Gruham Gallery if incorrect/objectionable property content is posted on the Site.

The user considers all information obtained from the Service, including listings, member directories, and any information otherwise made available to the User on the Service, to be the property of Gruham Gallery.
The user agrees that materials reserved for members will be maintained as confidential and protected as trade secrets of Gruham Gallery. Gruham Gallery does not guarantee the accuracy, endorsement, or recommendation of any material and the User uses such material at its own risk.
Users may access listings/advertisements on the Service only to obtain initial information from which further evaluation and investigation may be initiated. User shall limit access to and use of listings to personal and internal use and shall not use listings obtained from the Service for further distribution, publication, public display, or preparation of derivative works or to facilitate any of these activities in any way. User shall not use or reproduce any material obtained from the Service, or which is otherwise made available to User in the Service for or in connection with any other listing/advertising service or device. User shall not further use the Service provided by the Company for or in any other way in connection with any other listing service or device. Users who violate these Specific Terms, particularly those users who search the Service in an abusive or excessive manner, whether by automated or manual means, shall be subject to immediate termination of their membership without notice.

In that case, Gruham Gallery shall be free to terminate this Agreement immediately without notice to the User.
By allowing Users to access the Gruham Gallery, Gruham Gallery grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Services, provided that User complies with the terms and conditions of the Agreement.
